1. Agreement to Terms

By accessing or using Mention Scan ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

2. Description of Service

Mention Scan is a social media monitoring service that tracks mentions of keywords you specify across public social media platforms. The Service provides alerts, sentiment analysis, and notification features.

3. Account Registration

  • You must provide accurate and complete registration information
  • You are responsible for maintaining the security of your account
  • You must notify us immediately of any unauthorized access
  • You may not share your account credentials with others
  • You must be at least 18 years old to use the Service

4. Subscription and Billing

  • Paid subscriptions are billed monthly in advance
  • You can upgrade or downgrade your plan at any time
  • Downgrades take effect at the next billing cycle
  • Refunds are not provided for partial billing periods
  • We may change pricing with 30 days notice

5. Acceptable Use

You agree not to:

  • Use the Service for any illegal purpose
  • Harass, stalk, or harm others using information from the Service
  • Attempt to access data belonging to other users
  • Interfere with or disrupt the Service or servers
  • Circumvent usage limits or access controls
  • Resell or redistribute the Service without authorization
  • Use automated means to access the Service beyond normal API usage

6. Data and Content

  • You retain ownership of keywords and preferences you configure
  • Social media content displayed comes from public sources
  • We do not claim ownership of third-party content
  • You are responsible for your use of information obtained through the Service

7. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted service. The Service may be temporarily unavailable for maintenance, updates, or due to circumstances beyond our control.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MENTION SCAN SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING FROM YOUR USE OF THE SERVICE.

Our total liability for any claim arising from these Terms or the Service shall not exceed the amount you paid us in the twelve months preceding the claim.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

10. Termination

  • You may cancel your account at any time through your account settings
  • We may suspend or terminate accounts that violate these Terms
  • Upon termination, your right to use the Service ceases immediately
  • Data deletion follows our Privacy Policy retention schedule

11. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes via email or through the Service. Continued use of the Service after changes constitutes acceptance of the modified Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions.
